All references to the "Promoter" are to Bookseller Media Limited (company registration number 07201744) whose registered office is Ashcombe Court, Woolsack Way, Godalming, Surrey GU7 1LQ, as promoter of this competition. The term "entrant" refers to a person who participates in the competition.
It is the intention of the Promoter to create an audio recording of the competition’s winning entry. As such, entrants should pay particular attention to clauses 30-36 of these terms and conditions.
How to enter
- The competition runs from 2 September 2019 until 23:59 (BST) at the close of 29 September 2019, after which no further entries will be accepted as eligible.
- The competition is free of charge.
- Entries must be in Word or TextEdit form and emailed as an attachment to FutureBookComp@thebookseller.com. The body of the email should contain the entrant’s (i) full name, (ii) contact telephone number and email address, and (iii) short biography (maximum 100 words).
- The Promoter does not accept responsibility for late or lost entries and shall not be held responsible for any inability to submit entries as a result of computer service, systems and or server failure, error, interruption, defect or delay or any other technical malfunction. Proof of sending is not proof of receipt.
- The entries will be read and judged by a panel of judge, including:
(i) Philip Jones (The Bookseller);
(ii) Alice Lutyens (Curtis Brown);
(iii) Ellis Moore (Bolinda Publishing); and;
(iv) David Roper of Heavy Entertainment (together, the "Judges")
- The decision of the Judges will be final and no correspondence or discussion will be entered into.
- Entrants consent to being contacted by the Promoter and/or the Judges in response to their entry, using the contact telephone number and/or email address provided with their entry.
Eligibility
- Entrants must be 18 years old or over at the time of submission.
- The competition is open to entrants all over the world of any nationality or residency, subject to compliance of this competition with local laws.
- Only one entry is permitted per entrant. Entries on behalf of another person will not be accepted.
- Entrants may be agented, but should not be represented by either of the Judges or any agent within a Judge’s workplace.
- The competition is not open to (as applicable) literary clients, employees or contractors of: The Bookseller, any entity within the Original Talent Limited group (including Curtis Brown), Bolinda Publishing or Heavy Entertainment.
- In entering the competition, the entrant confirms that they are eligible to do so and eligible to claim any prize they may win. The Promoter may require entrants to provide proof that they are eligible to enter the competition.
- Entrants must comply with these terms and conditions to be eligible for the competition. The Promoter reserves the right to exclude entrants from participating in the competition if, at its sole discretion, the Promoter has any reason to believe that there has been a breach of these terms and conditions.
Competition entries
- The entry must be written in the English language.
- Entries must be no more than 5,000 words (not including the title).
- Entries must be entrants’ own original work and must not violate the copyright or other rights of any third party. The Promoter will not be held responsible for any libellous material included in an entry.
- Entries can be of any theme, subject or genre, but must be written specifically with audio in mind, based a single-voice narration (entrants may include a separate statement on how they perceive the audio recording could be made, but no more than 500 words).
- Entries must be intended for adults (i.e. not for children or young adults).
- Entries must not: be published in print, be broadcast as audio, or have won a prize. Being published in print includes, but is not limited to, self-publication.
- Simultaneous submission is permitted but if an entry wins a prize or is print published elsewhere the entrant must let the Promoter know as soon as possible so that such entry can be removed from the competition.
- Entries may not be altered after they have been submitted.
Prize
- From the entries submitted, the Judges will draw up a shortlist of five entries. The winner of the competition will decided by the Promoter on or before 28 October 2019.
- The Promoter will contact the prize winner personally as soon as practicable on or after this date, using the telephone number or email address provided with the entry.
- The Promoter will make all reasonable efforts to contact the prize winner. If the prize winner cannot be contacted within seven (7) days of the 28 October the Promoter reserves the right to offer the prize to the next eligible entrant.
- In the event of their being the competition winner, entrants consent to their full names and photograph (to be provided as soon as possible after the 28 October) being made public in the announcement of the competition winner.
- The prize for the winner of the competition is the production and publication of the original text in audiobook format, the “Audio Recording”.
- The prize must be taken as stated and cannot be deferred or transferred.
- The prize cannot be exchanged for cash.
Audio recording
- The Promoter does not claim any right of ownership in the entries. For the avoidance of doubt, entrants retain all rights in their entries save for audio rights in the prize winning entry in accordance with clauses 31-36 below.
- The prize winner agrees to the audio recording of their entry by Heavy Entertainment (the “Audio Recording”). The final creative decisions regarding editing, production and casting of the Audio Recording will be made by Heavy Entertainment. All costs associated with producing the Audio Recording will be met by the Promoter.
- Copyright and all other rights in the Audio Recording vest in the Promoter until 25 May 2020, at which point the Promoter and the prize winner will enter into an agreement assigning all rights and ownership in the Audio Recording to the prize winner. The Promoter’s use of the Audio Recording prior to 25 May 2020 is strictly subject to clause 36 of these terms and conditions.
- The prize winner agrees not to make an audio recording of their entry (either in part or in whole) from the date of submission of their entry up to and including 24 May 2020.
- The prize winner agrees to a free version of the Audio Recording being made available, without payment to the prize winner, as follows:
(a) At the FutureBook Conference 2019 on 25 November 2019 (the “Conference”).
(b) From the date of completed production of the Audio Recording up to and including 24 May 2020, on the following Audio platforms as distributed by Bolinda Publishing: Apple Books audiobook; Google Play; Audible; BorrowBox; Bolinda Audio Books.
- The prize winner agrees to attend the Conference, at their own cost, in order to take part in a discussion about the process of writing for audio [and the subsequent production process].
- Further to clause 32, during the period of its ownership of the Audio Recording the Promoter may not use the Audio Recording in any other capacity outside of clause 34(a)-(b) without the express agreement of the prize winner.
Data protection
- The Promoter will process entrants’ personal information as set out in its Privacy Policy: www.thebookseller.com/privacy-policy.
General
- Submission of an entry will be deemed to signify acceptance of these terms and conditions by the entrant and agreement to be bound by them and confirmation that the entrant has the necessary authority to enter into this competition.
- The Promoter reserves the right to hold void, suspend, cancel or change this competition at any stage, if deemed necessary.
- These terms and conditions are governed by the laws of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
- This competition is void where prohibited by local law.
